Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Daryl P Kelly, LLC ("allin1.contact," "we," "us," or "our") governing your use of the allin1.contact website, hosted Profiles and Pages, contact tools, Devices, memberships, physical products, and related services (collectively, the "Service").
1. Eligibility and account responsibility
You must be at least 18 years old and legally able to enter a contract. The launch service is intended for United States customers. You are responsible for accurate account information, protecting your credentials and recovery codes, and activity under your account. Do not share credentials or use another person's account without authorization.
2. What the Service provides
allin1.contact is a hosted service. A Profile stores identity and contact information; Pages present selected information and content; Contacts store information you choose to keep privately; Devices connect QR or NFC products to destinations you control. Physical products are optional and are sold separately when available.
3. Your content and permissions
You retain ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free license to host, copy, process, resize, transmit, display, and otherwise use that content only as reasonably necessary to provide, secure, operate, improve, support, and enforce the Service. You represent that you have the rights and permissions needed for content you submit and for contact information you collect or use through the Service.
Public Profile and Page content is intentionally public unless a feature says otherwise. Private Contacts and account settings are not public merely because you maintain a public Profile.
4. Acceptable use
You must comply with our Acceptable Use Policy, which is incorporated into these Terms. We may remove content, restrict features, quarantine or suspend Profiles, block accounts, or take other proportionate action when reasonably necessary to enforce these Terms, protect users, comply with law, or preserve Service security.
5. Memberships and recurring billing
Free membership has no recurring charge. Paid memberships renew automatically for the selected monthly or annual billing period until canceled. Before checkout we will display the plan, price, billing interval, renewal terms, and material limitations. By completing paid checkout, you authorize recurring charges through our payment provider until cancellation.
You may cancel recurring billing through the billing portal or another cancellation method we make available. Cancellation stops future renewals and ordinarily leaves paid access active through the already-paid period. Except where law requires otherwise or we expressly state otherwise, subscription charges are non-refundable and we do not prorate unused time. 6. Downgrades and purchased Devices
A downgrade or membership expiration does not intentionally delete over-limit customer data. Paid-only behavior may become inactive and new growth may be limited until your usage is within the applicable plan. A legitimately purchased Device is not intentionally disabled merely because a paid membership expires; its supported basic destination continues at the Free baseline. If you close your account, Devices still owned by that account may be disabled, so transfer any Device you want another person to keep using before account closure.
7. Physical products
When physical products are offered, product pages and checkout control the product description, price, customization, estimated fulfillment information, and included membership time or feature access. Customer-approved personalization is produced from the information you submit, so you are responsible for spelling, artwork, destination choices, and other approved customization. Shipping, cancellation, return, and delay rules are described in our Shipping & Returns Policy. Covered manufacturing defects are addressed by our Limited Warranty.
8. Payments, taxes, and charge disputes
Payments are processed by third-party payment providers and acquiring partners. Card details are tokenized by the payment provider; allin1.contact does not require you to provide us with full payment-card numbers. You are responsible for applicable charges and taxes shown at checkout. If you believe a charge is wrong, contact support promptly so we can investigate. This does not limit any lawful chargeback or consumer-protection rights.
9. Contact exchange and communications
If you use Share My Info, Keep Updated, or similar features, you choose to provide information to another customer or maintain a relationship with them. The receiving customer is responsible for their independent use of information they receive. Service, security, billing, legal, and account messages may be sent electronically. Marketing messages, if introduced, will be handled separately and subject to applicable opt-out rights.
10. Intellectual property
The Service software, design, trademarks, and materials supplied by us are owned by us or our licensors. These Terms do not transfer our intellectual property to you. Copyright complaints are handled under our Copyright / DMCA Policy. We maintain a policy for terminating repeat infringers in appropriate circumstances.
11. Account closure and termination
You may request account closure from Account Settings. A cooling-off period allows cancellation of the closure request before completion. Completion may cancel active subscriptions, archive public Profiles, disable Devices, close account access, and anonymize the login identity. We may retain transaction, fraud-prevention, legal, tax, warranty, moderation, and other records when reasonably required. We may suspend or terminate accounts for material or repeated violations, fraud, security threats, legal requirements, or nonpayment.
12. Service changes and availability
We may maintain, update, secure, and change the Service. We will not intentionally use a membership downgrade to brick legitimate purchased hardware, but no hosted service can promise perpetual availability. If we materially discontinue a paid Service feature during a prepaid period, we will provide a reasonable remedy appropriate to the circumstances and applicable law.
13. Disclaimers
Except for any express written warranty on physical products and rights that cannot legally be excluded, the Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, a specific business result, search ranking, contact conversion, or compatibility with every third-party device, browser, NFC reader, embed provider, or external website.
14. Limitation of liability
To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Service. To the fullest extent permitted by law, our aggregate liability arising from the Service will not exceed the greater of (a) the amount you paid us during the 12 months before the event giving rise to the claim or (b) $100. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
15. Indemnity for business misuse
If you use the Service on behalf of a business, you will defend and indemnify us against third-party claims arising from your unlawful content, your infringement of another person's rights, or your material breach of these Terms, except to the extent caused by our own conduct. Consumer users are not required to indemnify us where such an obligation is prohibited by applicable law.
16. Governing law and disputes
These Terms are governed by the laws of Missouri, without regard to conflict-of-law rules, except that mandatory consumer protections of your home jurisdiction continue to apply when they cannot be waived. Before filing a lawsuit, we ask both sides to make a good-faith effort for 30 days to resolve the dispute through support. Subject to mandatory law, court proceedings may be brought in the state or federal courts serving Webster County, Missouri.
17. Changes to these Terms
We may update these Terms for legal, security, operational, or product reasons. We will post the new version and, when a change is material, provide reasonable notice. Authenticated customers may be required to accept a new policy version before continuing to use customer features. Staff Operations access is governed separately by staff authorization and security controls. Changes do not retroactively alter completed purchases where prohibited by law.
